FACTS
In Sulphur, Louisiana in 2002, Jonathan Edward Boyer and Anthony, his brother were going for a walk; when Bradlee Marsh gave them a ride, Boyer demanded he give him his money. When Marsh refused, Boyer shot him in the head 3 times, took his money and then his silver chain. As a result of his injuries, Marsh died.
Boyer was indicted on second degree murder and armed robbery with a firearm in Louisiana State Court. He was found guilty on both counts by a jury of his peers. Boyer requested a motion for an appeal but was denied the motion and was sentenced to life in prison without parol, for the second degree murder charge and 104 years, without parol for the armed robbery charge.
Boyer argued that the court made a mistake determining his mental capacity. The State denied Boyer's brother, Anthony, to testify against him because Anthony had violent tendencies. Thus, giving Jonathan Edward Boyer an excessively long sentence.
The court of appeals argued that the trial court did not abuse its discretion, and was not prejudice towards Boyer.
Case will be argued in front of the Supreme Court, Monday, January 13, 2013.
