ARGUMENTS
Jonathan Edward Boyer spent over seven years awaiting trial. The first 5 years, he spent waiting an appointment of counsel. The State Appellate Court was aware that the delay violated Boyer's right to a speedy trial and blamed it on funding problems that were beyond their control. When in fact, the delay was fault of the State of Louisiana. It refused to meet its constitutional responsibility of providing counsel for the people it chooses to prosecute.

Jonathan Edward Boyer was not given an attorney due to insufficient funds. Seeing how the issue was their hands they did not violate Mr. Boyer's 14th amendment right to a fair and speedy trial. It was not in the courts intension to delay the trial by not providing Mr. Boyer an attorney nor by denying him the right to have his brother Mr. Anthony Boyer testify in his defense. Anthony had made an agreement with the court therefore making him ineligible to testify in defense of Mr. Boyer.
